Agreement to Terms
By using the services of BlueSummit Paramount Pool Services, you agree to these Terms of Service. If you do not agree with any part of these terms, please do not use our services. We reserve the right to update these terms at any time. Your continued use of our services after changes are posted means you accept the updated terms.
Services Provided
BlueSummit Paramount Pool Services provides professional pool cleaning, maintenance, and repair services. We offer weekly cleaning, one-time cleaning, equipment repairs, filter services, tile cleaning, and other pool-related services as described on our website. The specific services you receive will be outlined in your service agreement.
We will perform all services in a professional manner using standard industry practices. However, we cannot guarantee specific results or outcomes. Pool conditions depend on many factors including weather, usage, existing equipment condition, and water source quality.
Scheduling and Access
For weekly service, we will establish a regular day and approximate time for visits. You agree to provide us with access to your pool area during scheduled visits. This may include providing gate codes, keys, or ensuring gates are unlocked. If we cannot access your pool for reasons beyond our control, we may charge a trip fee and reschedule the service.
You are responsible for keeping dogs or other pets secured during our visits. You must inform us of any hazards on your property including aggressive animals, unstable surfaces, or other safety concerns.
Payment Terms
Payment is due according to the schedule outlined in your service agreement. For weekly service, payment is typically due monthly. For one-time services, payment is due upon completion unless other arrangements are made in advance. We accept various payment methods as indicated in your agreement.
Late payments may result in service suspension and late fees. If your payment is more than 30 days overdue, we reserve the right to terminate service and pursue collection of outstanding balances. You will be responsible for any collection costs including legal fees.
Cancellation Policy
You may cancel weekly service at any time with 14 days written notice. Cancellations without proper notice may result in charges for the notice period. For one-time services, cancellations must be made at least 24 hours before the scheduled appointment to avoid cancellation fees.
We reserve the right to discontinue service at our discretion with appropriate notice. Reasons may include non-payment, repeated access issues, safety concerns, or other valid business reasons.
Limitation of Liability
We carry appropriate insurance for our business operations. However, our liability is limited to the amount you paid for the specific service in question. We are not responsible for pre-existing conditions or damage caused by factors beyond our control including equipment failure, weather events, or improper pool construction.
You agree to hold us harmless from any claims, damages, or expenses arising from your use of your pool or from conditions we did not cause. This includes injuries to persons or damage to property that occurs on your premises.
Equipment and Repairs
When we perform equipment repairs or replacements, we will use quality parts and professional installation methods. We provide warranties on parts and labor as specified at the time of service. However, we are not responsible for equipment failures that result from age, improper use, or circumstances beyond our control.
We will notify you if we identify equipment problems that require repair. You authorize us to perform emergency repairs up to a specified dollar amount as agreed in your service contract to prevent further damage. Non-emergency repairs will be discussed with you before we proceed.
Chemicals and Water Balance
We will maintain your pool water chemistry within industry-standard ranges. However, water chemistry can change rapidly due to weather, usage, and other factors. We are not responsible for algae growth, cloudy water, or other water quality issues that develop between our scheduled visits unless caused by our error or negligence.
You agree not to add chemicals to your pool without consulting us first. Adding chemicals between our visits can interfere with our service and may void our responsibility for water quality. If you choose to add chemicals yourself, please inform us at our next visit.
Governing Law
These terms are governed by the laws of the State of California. Any disputes will be resolved in the courts of Los Angeles County. You agree to attempt to resolve any disputes through good faith negotiation before pursuing legal action.
